Limited Liability Terms & Conditions

1.  To initiate a claim, the Customer must notify the Carrier:

a)  In the event of Damage to GoodsPhotographic evidence of packaging and damage must be provided by the receiving customer either to the sending customer or sending / receiving depot provided within 24 hours of the Goods being delivered. Supporting documentation must also be provided showing that the notification was given within 24 hours (e.g. a copy of an email or a message with a time stamp). A formal claim must be received in writing within 7 business days of delivery of the Goods; or
b)  In the event of Loss of Goods – within 30 business days from the date the Goods were picked up by the Carrier. The Carrier has the right to amend these terms and conditions at any time including, but not limited to, extending the timeframe before a parcel is deemed lost due extenuating circumstances such as lockdowns, restrictions or events outside of the Carrier’s control.
c)  All information reasonably requested by the Carrier, or its third party claims administrator, in relation to the claim must be provided in writing within 14 business days of the request being made.

2.  If an Authority to Leave is provided on a consignment, whether it is a standing Authority to Leave or not, then the Customer waives their rights to lodge a claim in the event that Goods are deemed lost provided the Carrier can substantiate that the Goods were delivered by providing either photographic evidence or GPS tracking.

3.  The Claims Administrator also has the sole discretion and right to offset any claim amount against unpaid or outstanding monies owed to the Carrier.

4.  Claims are limited to loss or damage to Goods only. For the avoidance of doubt, any consequential loss or additional damage suffered by the Customer as a result of loss or damage to Goods, irrespective of the reason, will not be covered and cannot form part of any claim.

5.  Documentary evidence to support the value of the Goods must be provided by the Customer by either:

a)  Receipt of purchase; or
b)  Sufficient proof of actual manufacturing cost.
      1. If sufficient proof of actual manufacturing cost cannot be provided, the associated sales invoice, the value of which a       maximum of 35% will be paid to the Customer.
c)  Any claim for damaged Goods can only be initiated once the Carrier has possession of those Goods. Failure to provide the damaged Goods to the Carrier will waive the Customer’s right to initiate a claim.
d)  The Customer may only lodge a claim if it can be ascertained by accredited scanning that the Goods were lost or damaged in the direct care, custody and control of the Carrier and/or its Agents.

Art Work Clause

Loss or Damage to artwork is excluded from Warranty cover unless the Customer complies with the following conditions:

1.  It is a condition of the Policy that Artwork is:

a)  Professionally packed by a suitable and reputable independent third party, and that such third-party packers compile a detailed inventory of all items, inspect all items upon packing and provide a report detailing any existing damage such as (but without prejudice to the generality of this clause) chips, dents, scratches, damage to paint work, rust, oxidisation and discolouration.
b) When carried by air or by land, the artwork must be carried in a fully enclosed cargo space.
c) When carried by water, the artwork must be carried in a closed container.
d) The artwork must be supported by a recent and recognised valuation certificate.

Risk Exclusions

Loss or Damage to the Goods arising from the following risks are excluded from Warranty cover:

a)  Rust, oxidisation, discolouration;
b) Rejection, detention, condemnation or confiscation of the Goods by any government or their agencies or departments or by any public or local authority;
c) Dismantling, assembly, testing or fabrication of the Goods other than as required during ordinary course of provision of the Services

Loss and Damages Exclusions

The Company is not liable to pay Warranty cover when Loss or Damage to the Goods results from:

a)  Ordinary wear and tear of the Customer’s Goods and where the burden of proof that any such damage was not pre-existing damage and that it arose during the Service rests on the Customer;
b) Faulty manufacture or inherent defects of the Customer’s Goods;
c) Wars or strikes, actions of government or customs authorities (including rejection or refusal of importation permission for the Goods), nuclear or radioactive contamination;
d) Mould
e) Insufficiency, deficiency or unsuitability of packing of the Goods particularly when not packed at or above the standard set by original manufacturers for the type or mode of transit(s) used;
f) Mechanical or electrical breakdown or malfunction where no external evidence of damage can be shown;
g) Loss of data;
h) Goods destroyed by foreign government or customs authorities due to non-compliance with foreign laws/regulation or delay in collection

Geographic Exclusions

General exclusions applying to all sections of this policy

This policy excludes loss, damage, destruction, cost or expense of any nature directly or indirectly caused by, contributed to by, resulting from, arising out of or in connection with any of the following, regardless of any other cause or event contributing concurrently or in any other sequence to the loss.In no case shall this insurance cover loss, damage, liability or expense directly or indirectly caused by or contributed to by or arising from:

For a claim to be successful, any loss or damage must be reported to Couriers and Freight within 7 days of the actual or anticipated arrival of the goods.
